The protection of the Regional or Minority Languages in Spain: the legal status of the asturian language

ABSTRACT

The Statutes of Autonomy reform process has shown the transcendence of languages and their regulation. The adoption of the new Statutes of Autonomy and their legal developments trigger reconsideration and, in some cases, revision, of the Spanish constitutional model of linguistic pluralism (art. 3 of the Spanish Constitution). The author focuses on the level of protection provided by the Statutes of Autonomy to some languages, not declared as official: these languages are more protected by the Statues of Autonomy than by the safeguard clauses including legal recognition of linguistic rights. In order to study their role in the Spanish constitutional model, a reflection on the content and implications of the legal category of linguistic form is needed.
